Welcome to Pierced Heart. The terms “we”, “us” and “our” refer to Pierced Heart, a Danish clothing brand registered within the EU (VAT: 45688615). Pierced Heart operates this online store and website, including all related information, content, features, tools, products and services (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”) together with our [Privacy Policy] and [Refund Policy] describe your rights and obligations when using our Services. By visiting, interacting with or making a purchase through our store, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Definitions

Customer / you: any person accessing or purchasing through our Services.

Products: all clothing, accessories or other items offered by Pierced Heart.

Order: a purchase made by you through our Services.

Services: our website, online store, and all related features operated by Pierced Heart.

2. Eligibility and Account

You confirm you are at least 18 years old or the age of majority in your country and have legal capacity to enter into a contract.

If you create an account, you must provide accurate and complete information and keep your login secure.

You are responsible for all activities under your account.

3. Products

We do our best to display product details, colors, and sizes accurately, but differences may occur depending on your device.

Products, prices, and availability may change without notice.

We reserve the right to limit sales of products to specific regions or individuals.

4. Orders

Placing an order constitutes an offer to purchase. We may accept or decline orders at our discretion.

You will receive an order confirmation by email once payment is processed.

Please review your order carefully before submitting. Cancellations may not be possible once processed.

Purchases are subject to our [Refund Policy], including the EU 14-day right of withdrawal (see Section 5).

5. Right of Withdrawal & Returns

Under EU law, you have the right to withdraw from your purchase within 14 days of receiving your order, without giving any reason.

You must return the products in unused, original condition, with packaging intact. You bear the direct cost of return shipping.

Refunds will be processed within 14 days of receiving the returned products.

Exceptions: The right of withdrawal does not apply to:

Custom or personalized items.

Products that cannot be returned for hygiene reasons (e.g., pierced jewelry, worn clothing).

6. Prices and Billing

Prices are displayed in the currency of your location (e.g., DKK for Denmark, EUR for other EU countries, or local currency where available).

All prices include Danish VAT (25%) unless otherwise stated.

Only shipping costs are added at checkout. Pierced Heart does not charge extra order fees or handling fees.

For customers outside the EU: local customs duties, import taxes, or clearance fees may apply. These are not included in your order and must be paid by you directly to local authorities if required.

The price charged for a product will be the price in effect at the time the order is placed and confirmed in your order email.

You agree to provide valid and accurate payment details and authorize us to charge your chosen payment method.

Currency Conversion: If your bank requires conversion, they may apply their own exchange rates and fees. Pierced Heart is not responsible for these costs.

Payment Security: Payments are processed securely via Shopify Payments or trusted third-party gateways. We do not store card details.

7. Shipping and Delivery

We ship worldwide, but delivery times vary depending on location.

Delivery times shown are estimates only; delays caused by carriers or customs are beyond our control.

Risk of loss transfers to you once the order is handed over to the shipping carrier.

Non-EU Customers: You are responsible for any customs duties, import taxes, or clearance fees. If these are not paid, the package may be returned or destroyed, and we cannot refund unclaimed orders.

8. Intellectual Property

All trademarks, designs, logos, text, images, and content on our Services belong to Pierced Heart or our licensors. You may not copy, reproduce, or use them without prior written consent.

9. Third-Party Tools and Links

Our Services may include tools or links from third parties. These are provided “as is” without warranties, and your use is at your own risk.

10. Relationship with Shopify

Our store is powered by Shopify, but all sales are made directly with Pierced Heart. Shopify is not responsible for your purchases, shipping, or returns.

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including strikes, natural disasters, pandemics, supply chain issues, or government restrictions.

18. Governing Law & Dispute Resolution

These Terms are governed by Danish law and EU consumer regulations.

Any disputes shall be resolved in the competent courts of Denmark.

19. Severability and Waiver
